Terms and Conditions for 13870979 Canada Ltd. O/A Handy Henry Concrete
- Introduction 1.1 These Terms and Conditions (the "Agreement") govern the provision of concrete services (the "Services") by 13870979 Canada Ltd. operating as Handy Henry Concrete (the "Company") to its residential and commercial clients (the "Customer"). 1.2 By submitting a deposit, the Customer agrees to abide by the terms and conditions outlined in this Agreement.
- Deposits and Payment Schedule 2.1 The Customer must provide a deposit equal to fifty percent (50%) of the total contract price before the Company commences any work. 2.2 An additional payment of twenty-five percent (25%) of the total contract price is due once the concrete has been poured. 2.3 The final payment of twenty-five percent (25%) of the total contract price is due upon completion of cutting, sealing, topsoiling, and final cleanup. 2.4 The Customer acknowledges that the final payment is due upon completion of the Services per the quote and does not require customer approval or satisfaction. 2.5 The Company is not liable for any losses related to deposits held by the Company. 2.6 The Customer can request the return of their deposit at any time without penalty, provided the work has not commenced. 2.7 The Company reserves the right to return deposits for work not yet started at any time and for any reason, without incurring interest on the held funds. 2.8 By submitting the deposit, the Customer agrees to the terms and conditions of this Agreement.
- Scheduling and Completion Dates 3.1 The Company will make every effort to complete the Services by the estimated completion date provided to the Customer, but completion by the estimated date is not guaranteed. 3.2 The Company is not liable for any delays or early completions of the Services relative to the scheduled completion dates. 3.3 The estimated completion date is subject to change based on factors beyond the Company's control, including but not limited to weather conditions, material availability, and unforeseen circumstances.
- Scope of Services 4.1 The Company is responsible for providing only the Services explicitly listed in the sales estimate given to the Customer. 4.2 The Company is not responsible for any additional services not included in the sales estimate.
- Quality and Liability 5.1 The Company does not guarantee the quality of the completed work and does not provide any warranties, express or implied, regarding the quality or durability of the Services. 5.2 The Customer acknowledges that concrete is a natural material subject to variations and potential imperfections, including cracks and discolorations. 5.3 The Company is not liable for any cracks, imperfections, or other issues that may arise after the completion of the Services while the concrete is curing. 5.4 By submitting the deposit, the Customer agrees to waive any liability against the Company for any defects, imperfections, or issues with the completed concrete work. 5.5 The Company does not guarantee the longevity or effectiveness of sealing on stamped concrete beyond one year from the initial sealing date.5.6 The Company does not offer re-sealing services for stamped concrete. The Customer is responsible for any maintenance or re-sealing required after the initial service.
- Waiver of Liability 6.1 By submitting the deposit, the Customer agrees to waive any liability against the Company for any defects, imperfections, or issues that may arise with the completed concrete work after the Services are completed. 6.2 The Company is not responsible for any subsequent issues that arise once the concrete has set. 6.3 The Customer agrees that dissatisfaction with the quality of the work does not constitute grounds for withholding final payment.
- Amendments and Updates 7.1 The Company reserves the right to amend or update this Agreement at any time without prior notice to the Customer. 7.2 It is the Customer's responsibility to periodically review this Agreement to stay informed of any changes.
- Governing Law 8.1 This Agreement is governed by and construed in accordance with the laws of the jurisdiction in which the Company operates. 8.2 Any disputes arising under or in connection with this Agreement shall be resolved in the courts of the jurisdiction in which the Company operates.
